The Pentagon wanted AI with 'minimal refusal rates'. OpenAI says it turned the language down
Documents obtained by The Intercept show the Defense Department sought a version of OpenAI's models 'designed for national security use cases' with 'minimal refusal rates'. OpenAI says that clause was a draft it rejected and is not in the executed $200m contract. Either way, it names the tension at the heart of military AI.

A "refusal" is what happens when an AI model declines a request. Ask a consumer chatbot to help plan a drone strike and it will say no — The Intercept reports that ChatGPT, asked for a targeting scheme, replies: "I can't provide a prioritization scheme for conducting UAV airstrikes against specific enemy combatants." That refusal is a safety guardrail working as designed.
According to documents obtained by The Intercept, the US Defense Department wanted fewer of them. A contract deliverable describes "OpenAI Mission Models" as models "designed for national security use cases" that "have minimal refusal rates" — language that appears in contract version P00003, part of a deal worth up to $200 million over two years.
What that phrase means
Stripped of the procurement wording, "minimal refusal rates" describes an AI that rarely tells the military no. Heidy Khlaaf — chief AI scientist at the AI Now Institute and a former OpenAI systems safety engineer — quoted by The Intercept, put it plainly: minimal refusal "is likely referring to little or no safeguards on the model being used." The refusals in question are precisely the ones that sit between a model and a request it was built to decline.
OpenAI's denial
OpenAI disputes that it signed up to this. Spokesperson Nate Evans told The Intercept: "OpenAI has never agreed to contract language requiring 'minimal refusal rates.' This language does not appear in our executed contract." He said the document was "an earlier draft proposed by the Department before we provided feedback. We rejected that language, the department agreed to remove it, and the final executed agreement does not include it."
That denial matters and belongs up front. On OpenAI's account, this is the Pentagon asking for a low-refusal model, not OpenAI agreeing to build one. But the ask is itself the story: the customer wrote down, in a contract draft, that it wanted the safety guardrails turned down.
Why it still matters
The tension it exposes does not depend on whose draft it was. Militaries want AI that acts; safety refusals exist to stop AI acting on the most dangerous requests. "Minimal refusal rates" is the point where those two goals collide, written into a government document.
And OpenAI is not alone in the room. OpenAI, Google, xAI and Anthropic all agreed in 2025 to develop militarized prototypes of their frontier models, for uses the contracts describe as logistics, military intelligence, decision-making and general "warfighting." The refusal question — how readily a military model should decline — now sits inside all of that work, whatever any single contract's final wording says.
