The phrase everyone hides behind
Ask any AI company or defense ministry about autonomous weapons and you'll hear the same reassurance: there's always a human 'in the loop.' It's the load-bearing phrase of the entire debate — and it may be the weakest.
What 'meaningful' is supposed to mean
The ICRC and arms-control scholars use a more demanding standard: meaningful human control. As analyses in the Small Wars Journal and elsewhere set out, that means more than a human being physically present. The human must have the time to consider, the information to understand the AI's reasoning, and a genuine, exercisable ability to override or redirect the system. A human with legal responsibility but no real agency isn't control — it's a liability shield.
The rubber-stamp problem
Here's the failure mode critics fear. A human cannot exercise true agency if they lack the time or information to contest a machine's high-confidence recommendation. At that point the 'human in the loop' becomes a rubber stamp for an automated process — while remaining legally responsible for outcomes they could neither predict nor prevent. The operator often can't even reconstruct why the system flagged a particular person or object.
The reported Israeli Lavender case is the archetype: humans nominally approving targets, but at a tempo — reportedly seconds per name, thousands of names — where genuine judgement is impossible. This is precisely the zone Anthropic's red lines don't reach: their line is about fully autonomous weapons that fire without a human, not about AI-accelerated kill chains where a human nominally signs off. As Lawfare noted, that's the harder, unaddressed question.
The other side: trust, not removal
It's worth being fair to the strongest version of the pro-AI case, because there is one. DARPA's Air Combat Evolution program put an AI in control of a modified F-16 (the X-62A / VISTA) and flew it in real dogfights against a human-piloted F-16 in 2023–24 — a world first. DARPA was explicit that the program is not really about dogfighting; it's about building trust in responsible, human-supervised AI in high-stakes, split-second environments where a human alone may be too slow. Done right, AI can keep a human meaningfully in command of decisions they couldn't otherwise make in time.
The unresolved core
So the phrase cuts both ways. 'Human in the loop' can describe a genuine partnership where AI extends human judgement — or a fig leaf where a human absorbs accountability for a machine's choices. The entire ethics-and-law debate, and every contract red line, ultimately turns on which one you're actually building. Right now, nobody has agreed how to tell the difference from the outside — which is exactly why the treaty talks, the company policies and the public arguments remain unresolved.
